Towards independent living: Collecting examples from Europe

This Collection is a joint initiative of the European Network on Independent Living (ENIL) and the European Disability Forum (EDF). It features examples from different EU Member States, which to a different extent facilitate the right to live independently in the community.

The examples are divided into four areas, presented in different chapters:

  • Legislation and funding: State Funded Peer-Counselling – Estonia; Direct Payments – Ireland.

Reimagining the workplace: disability and inclusive employment

This UK based report examines the challenges and barriers facing disabled people throughout their working journey, as well as considering solutions to some of the key issues. Through our own research survey and interviews we look at the impact on disabled people where they cannot access adequate support as well as what works in improving their employment prospects

 

Topics discussed include: conditions of employment; preparing for work; falling out of work; and the performance of government based programmes.

 

ComRes interviewed in 2018 online 1,647 disabled adults in the UK, aged between 18 and 65, and in 2017 they interviewed 1,609 disabled adults. ComRes interviewed 503 UK line managers responsible for or involved in the recruitment process in 2018 and in 2017.  Between 1 December 2018 – 20 January 2019, Leonard Cheshire conducted in-depth telephone interviews with seven disabled people of working age about their experiences of employment.

This is the third issue of European Disability Forum's annual European Human Rights report Series focus on Ensuring the rights of persons with disabilities to equality and non-discrimination in the European Union. The report includes a review of equality frameworks in each EU Member State and a section on multiple and intersectional forms of discrimination. The report aims to inform organisations of persons with disabilities and policymakers of the current state of protection against discrimination based on disability in the European Union and draws recommendations with the goal of reaching inclusive equality for all persons with disabilities. The first chapter provides background information about the UN Convention on the Rights of Persons with Disabilities. Chapter 2 describes what constitutes discrimination on the grounds of disability and the obligations of States under international human rights law. Chapter 3 focuses on multiple and intersectional discrimination, by examining the effect of the intersection of disability with other grounds of discrimination. Looking at current practice, Chapter 4 describes the state of play at national level, with Chapter 5 looking at the EU level, specifically considering the current gaps in ensuring better protection against discrimination based on disability. Finally, the report draws conclusions and recommendations addressed to the EU and its Member States.  

Budgeting of pre-school education for children with disabilities in the municipalities of Elbasan and Korca

The study on the budgeting of preschool education for children with disabilities was conducted in the municipalities of Elbasan and Korça. It is structured into 5 chapters. Following the introduction (Chapter 1) and the description of the methodology (Chapter 2), Chapter 3 provides the legal and institutional context of inclusive education as well as the crosscutting with the territorialadministrative reform (of 2014) and decentralization. Chapter 4 argues the need for inclusive pre-school education from child rights approach and of longterm economic benefits. This chapter identifies and describes in detail the educational services, rehabilitation services and support services that facilitate the inclusion of children of children with disabilities (0-6 years) in the inclusive preschool education. This chapter provides also information on the number of 0-6 year old children with disabilities, public education structures that apply inclusive pre-school education and the number of children with access to these structures.. Chapter 5 describes and analyzes the funding aspect of inclusive education in the two municipalities under the study.

The right to live independently and be included in the community : Addressing barriers to independent living across the globe

This reports looks at the main barriers to the realisation of disabled people’s right to live independently and be included in the community, which is set out in Article 19 of the UN Convention on the Rights of Persons with Disabilities (CRPD). They are grouped in seven broad areas: (1) misunderstanding and misuse of key terms, (2) negative attitudes and stigma, (3) lack of support for families, (4) prevalence of institutional services, (5) barriers related to community support services, (6) barriers in mainstream services and facilities, and (7) barriers, concerning other CRPD provisions, with effect on Article 19. A set of recommendations is also provided, outlining measures required to address these barriers.

The recommendations in this report – presented below - were shared with the UN Committee on the Rights of Persons with Disabilities when they were drafting the General Comment on Article 19. They can be used by governments and civil society organisations, alongside the General Comment, to identify actions needed to implement Article 191 CRPD.

 

Directive on accessibility of the websites and mobile applications of public sector bodies : Toolkit

The European Union (EU) Directive on accessibility of the websites and mobile applications of public sector bodies was adopted on 26 October 2016. EU Member States will have until September 2018 to transpose this EU legislation into national law. This toolkit aims to provide key information about this EU legislation and advice for the transposition phase. Section 1 provides a timeline for transposition and implementation of the Directive, some key definitions, identification of key players and an explanation of the directive being a ‘minimum harmonisation’ Directive. Section 2 provides understanding of what the Directive covers, explains key provisions (scope, accessibility requirements, exemptions, enforcement, monitoring, etc.) and gives advice to DPOs (disabled people's organisations) concerning what they can do at national level to ensure the best possible implementation for persons with disabilities in their country

Disability in the EU SDGs indicators: Ensuring that no one is left behind

The European Disability Forum (EDF) presents this position paper in response to the draft report of EUROSTAT on the European Union (EU) – Sustainable Development Goals (SDGs) indicators circulated on 21st March to civil society organisations. The 2030 Agenda adopted by the United Nations in New York has 11 references to persons with disabilities and the SDGs have 19 references, including the technical ask to disaggregate data by disability.

However, EUROSTAT has overlooked persons with disabilities in its latest indicators draft. Now there is an opportunity to ensure this gap is filled and for the EU to include disability related indicators in line with the 2030 Agenda and the UN Convention on the Rights of persons with disabilities (UN CRPD).

The European Commission (EC) has a legal obligation under the UN Convention on the Rights of Persons with Disabilities (UNCRPD) to promote, protect, and ensure the full enjoyment of human rights by persons with disabilities. The EC is also legally bound to ensure that persons with disabilities enjoy full equality under the law. EUROSTAT has also the technical capacity to measure the inclusion of persons with disabilities in its approach to the SDGs, and in this paper we outline why and how this could be done. Here are four guiding recommendations: 

  • The systematic disaggregation of data by disability
  • The insertion of the SDGs disability indicators in the EU SDGs indicators
  • The provision of leadership from the EU in the application of the obligations under the UN CRPD in the context of the SDGs 
  • The participation of persons with disabilities throughout the process

A study on the equal recognition before the law - Contribution towards the Council of Europe strategy on the rights of persons with disabilities (2017)

This study aims to identify ways and means of implementation of Article 121 of the UN Convention on the Rights of Persons with Disabilities (CRPD) which affirms the right to equal recognition before the law. It represents a paradigm shift to identifying persons with disabilities as subjects with legal rights. There are 4 parts. Firstly, the scope of the obligations contained in Article 12 is analysed. Secondly, the approaches taken by various member States of the Council of Europe to comply with Article 12 of the CPRD by way of law reform and shifts in policies and practices are surveyed. Good practice examples from member States are then provided to demonstrate approaches which show potential for fuller alignment with Article 12.  Finally, a recommended set of measures is set out to provide guidance to member States on how best to reform their legal architecture in accordance with the requirements of Article 12.

Promoting equality and non-discrimination for persons with disabilities

"Ensuring equal opportunities for persons with disabilities is an important facilitator of participation and inclusion in society. Both the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) and the Council of Europe Disability Strategy 2017-2023 address equality and equalisation of opportunities for persons with disabilities. Article 5 of the UNCPRD requires States to adopt positive measures aimed at ensuring equality across the substantive rights in the Convention. The Council of Europe Disability Strategy aims at guiding and supporting the activities of Council of Europe member States in their implementation of the UNCRPD and Council of Europe standards regarding disability, and similarly addresses equality and non-discrimination.

The overall goal of this study is to analyse the obligations contained in the UNCRPD regarding equality and non-discrimination, and to provide examples of good national practices regarding equality and non-discrimination"

Impact of cross-border healthcare on persons with disabilities and chronic conditions

"The International Federation for Spina Bifida and Hydrocephalus (IF) together with the European Disability Forum (EDF) and the European Patients Forum (EPF) conducted a survey among their networks to assess the impact of the Directive 2011/24/EU on the application of patients’ rights in cross border healthcare (crossborder healthcare Directive) on persons with disabilities and chronic conditions in the EU. The findings of the survey showed low awareness and low use of the Directive. A vast majority of 85% has never used crossborder healthcare even though 69% of respondents might have used it had they received information about it. Approximately three quarters (77%) of respondents have never heard about the Directive" 

Inclusive Education Booklets and Webinars

With the view to promoting Inclusive Education systems, the UNICEF RO for CEE/CIS in collaboration with the Education and Disability Sections at HQ, has developed a cohesive set of products related to Inclusive Education, products that will support the capacity development of UNICEF staff and provide them with a set of materials that can be used in the field. Below you can find a series of webinars and companion booklets, each dedicated to a specific thematic area, under the overall title of A Rights-Based Approach to Inclusive Education for Children with Disabilities.

The series is intended to provide practical guidance to UNICEF staff and their partners on the issues of Inclusive Education with a focus on children with disabilities, by exploring specific concerns, policy and implementation issues specific to thematic areas. The webinars provide the audience with the necessary tools and references to guide further study, and determine the capacity development needs of each country. Each webinar and its companion booklet was developed by an expert on a specific thematic area.

Progress Report on the implementation of the European Disability Strategy (2010-2020)

The Strategy is the main instrument to support the EU's implementation of the UN Convention on the Rights of Persons with Disabilities (UNCRPD). Progress in all eight areas of the strategy is reported: accessibility, participation, equality, employment, education and training, social protection, health and external action. Initiatives such as the Directive on Web Accessibility, the proposal for a European Accessibility Act, the EU Disability Card project (being piloted in 8 Member States) and provisions in the Erasmus+ programme (allowing better mobility for students with disabilities) are highlighted. 

 

This report presents progress achieved in the first five years of the Strategy and assesses implementation. Many stakeholders have contributed to this work. The United Nations reviewed how the EU has been implementing its obligations under the UNCRPD3, and issued Concluding Observations with concrete recommendations for follow-up. These contain guidance on priority issues while also highlighting the steps already taken (see Annex 3). The European Parliament and the European Economic and Social Committee subsequently prepared their own reports on the implementation of the UNCRPD, while civil society organisations provided analysis and proposals (see Annex 4). The Commission also launched a public consultation to collect views from a broad range of stakeholders on the current situation of persons with disabilities and the impact of the Strategy so far, gathering more than 1,500 contributions (see Annex 1). This report also looks at the role of the supporting instruments and at the implementation of the UNCRPD within the EU institutions. Finally, it looks ahead at how the Strategy will continue to deliver on its objectives. In addition, the report includes a comprehensive and up-to-date overview of EU legal acts with an impact on disability matters (Annex 5)

Right to health: Reality of persons with spina bifida and hydrocephalus

"This report maps the situation of persons with SBH in relation to healthcare access and is a follow up of the CRPD Concluding Observations Art.25. Through a comprehensive survey, IF collected valuable data on the experiences, satisfaction, and perceptions of healthcare coverage of individuals with SBH across Europe. Based on its findings, the financial coverage of treatment and assistive products for patients with SBH is grossly insufficient across the EU. Europe as a whole lacks multidisciplinary care and specialised SBH teams, which translates into long waiting times and insufficient knowledge of the SBH specificities. 

Considering these findings, IF urges the EU Member States to adequately support the healthcare needs of persons with SBH, and to invest more substantially into creating multidisciplinary clinics that can help avoid preventable complications 11 and may reduce the overall burden 12 on the patient and the system. In addition, the Member States should actively support creation of the European Reference Networks as a way of improving care for persons with SBH. IF also calls on the European institutions for support in training medical professionals on rights of persons with disabilities."

Greece: Refugees with Disabilities Overlooked, Underserved

Refugees, asylum seekers, and other migrants with disabilities are not properly identified and do not enjoy equal access to services in reception centres in Greece.  On the basis of research carried out in mainland Greece and on the Greek islands in October 2016 and January 2017, and follow-up phone interviews in December 2016 and January 2017, Human Rights Watch found that asylum seekers and refugees with disabilities are not properly identified in Greece, in part because of a rushed registration process and the need for better guidance for staff. Without an adequate understanding of the scale and needs, aid agencies cannot respond effectively. Problems with equal access to water and sanitation services, food distribution, shelter, and health care including mental health and psychosocial support are reported.

Satellite classes: A promising model for educating children and young people on the autism spectrum

Results of research into attempts to provide the best of both mainstream and specialist education for autistic children are presented. The ‘satellite class’ model of supported inclusion is where the strengths of a special school education are kept in place for selected autistic pupils as they transfer to dedicated classes within mainstream ‘host schools’. The schools studied were all within the London borough of Tower Hamlets, UK.

DFID data disaggregation action plan - Better data for better lives

This action plan sets out the steps that the UK Department for International Development (DFID) will take to promote, provide and make use of their own development and humanitarian programme data which can be disaggregated on the basis of sex, age, disability status and geography (in the short term). It also has the objective to build the culture within DFID on disaggregated data, and to work with others to change the international development system on disaggregated data. A review is scheduled for 2020. Working with partners, influencing, capacity building and management information, research, analysis and reporting are outlined. Trailblazer country programmes with Bangladesh, Nepal, Zimbabwe and Rwanda are reported.
